What happens if I don’t make a will?
If someone passes away without a will, their estate has to be divided following specific rules called the rules of intestacy. The person who didn't leave a will is called an intestate person.
Inheritance under intestacy rules is limited to married or civil partners and certain close relatives. If a will is made but isn't legally valid, the rules of intestacy determine how the estate gets distributed, disregarding the wishes expressed in the will.
